1. Introductory provisions
1.1. These terms and conditions (the “Terms”) govern the rights and obligations between Hyperbaric s.r.o. (the “Provider”) and the customer (the “Client”). The Client is the customer who uses the services provided at the Provider’s oxygen therapy centre.
1.2. The Provider offers in particular the following services:
- hyperbaric oxygen therapy,
- hydrogen therapy,
- Musculpting / muscle stimulation,
- non-invasive support for incontinence,
- other regenerative, preventive and wellness procedures from the current range.
1.3. The Terms form an integral part of every contract for the provision of a service concluded between the Provider and the Client.
1.4. By booking a service, the Client confirms that they have read the Terms, understand them and agree to them.
2. Nature of the services provided
2.1. The services provided are wellness, regenerative and preventive procedures. They are not health services within the meaning of zákon č. 372/2011 Sb., o zdravotních službách (Act No. 372/2011 Coll., on Health Services).
2.2. The services do not replace medical care. The Client is required to check with their doctor whether a given procedure is suitable for them.
2.3. The Provider is not responsible for the Client’s decision to undergo a procedure if the Client conceals their state of health, medication or other facts affecting its suitability.
3. Booking and reservations
3.1. Services can be booked in person, by phone, by email or through the booking system.
3.2. A booking becomes binding at the moment the Provider confirms it.
3.3. The Provider is entitled to refuse a service where capacity is full, or in the event of a technical fault or a contraindication. The same applies to any other reason preventing the procedure from being carried out safely.
4. State of health and the Client’s obligations
4.1. Before the procedure begins, the Client is required to inform the Provider truthfully about their state of health, in particular about:
- pregnancy,
- heart conditions,
- neurological problems,
- metal implants,
- the use of specific medicines,
- contraindications to a hyperbaric environment or to electromagnetic pulses,
- allergies to the materials used.
4.2. The Provider may ask for confirmation from a doctor, or refuse the procedure, where there is a health risk.
4.3. The Client is required to follow the instructions of our team.
5. Prices and payment terms
5.1. The current prices of the services are published on the Provider’s website or available at the centre.
5.2. Payment is made in advance or after the service has been provided, according to the instructions of our team. Prices are subject to change. If a price is displayed incorrectly on the website, the Provider does not guarantee the price shown.
5.3. The Provider may offer discounted service packages. The price of a package is payable in advance; the period in which it can be used is limited according to the offer.
5.4. Prices are quoted including VAT.
6. Cancelling or changing an appointment
6.1. A booking can be cancelled no later than 24 hours before the procedure begins.
6.2. If the Client cancels an appointment later than that, or does not attend, the Provider may charge a cancellation fee of 100% of the price of the service.
6.3. The Provider reserves the right to change or cancel an appointment for technical or operational reasons. The Client will be informed of any such change without undue delay.
7. Gift vouchers and packages
7.1. Gift vouchers are valid until the date stated on the voucher; once that date has passed, the entitlement expires.
7.2. A voucher cannot be exchanged for money.
7.3. If the Client does not attend a booked appointment and gives no notice, the voucher may be treated as used.
8. Liability and safety
8.1. The Provider is responsible for the safe technical condition of the equipment and for the professional conduct of the procedure.
8.2. The Client is responsible for their decision to undergo the procedure and for giving truthful information about their health.
8.3. The Provider is not liable for damage caused by inappropriate behaviour on the part of the Client or by failure to follow the instructions of our team.
8.4. The Client moves around the centre at their own risk.
9. Complaints
9.1. A complaint can be made in person, in writing or by email.
9.2. A complaint about a service will be settled within 30 days at the latest.
9.3. Complaints do not cover subjective expectations (for example an individual response of the body).
10. Personal data protection
10.1. The Provider processes the personal data of Clients to the extent necessary for bookings, for providing the services and for keeping records.
10.2. Processing follows the principles set out in the Privacy Policy published on the Provider’s website.
11. Final provisions
11.1. The Provider is entitled to change the Terms at any time. In the event of a material change, the updated Terms will be published on the website.
11.2. Legal relationships not governed by these Terms are governed by the law of the Czech Republic.
11.3. The Terms take effect on the day they are published.
